This contract is between the Client and Inspector only. The Client is the person who executes/signs this agreement. The Client and Inspector agree for valuable consideration the Inspector will perform a visual inspection of the accessible area of the property and provide the Client with a written report. Specifically those areas that were visible to the Inspector(s) at the time of inspection. Our inspections are performed in accordance with the Standards and Practices of the American Society of Home Inspectors (http://www.homeinspector.org/standards) which are incorporated as a part of this Inspection Report. Please read all sections of the Report, Contract, and the Standards of Practice and ask any question that you may have. Sign and initial all pages where indicated.
1. Ask Rick Inspections services, Inc. (ARIS) agrees to conduct an inspection for the purpose of informing the customer(s) of “possible issues, or concerns” in the condition of this property that were in existence at the time of inspection and visible to the inspector(s). Maintenance Items and Surface Defects may be discussed but are not a part of the scope of this report. This inspection is not to determine compliance with any current or past governmental codes and is not technically exhaustive. A technically exhaustive report is available for $8,500.00 and will take additional time. This inspection and report are performed and prepared for the sole confidential and exclusive us and possession of the customer(s) named above. It is not transferable.
2. Inspector Limitations: It is understood that the inspector cannot see through solid objects. Latent and concealed defects and deficiencies are excluded from this inspection. The inspector is not required to dismantle equipment beyond normal access panels and will not shovel snow or perform destructive testing.
3. Statute of limitations: No suit or action of any kind shall be brought against ARIS, its agents or inspectors by the Client or Client’s agent or heirs for any reason beyond one year from the date of inspection.
4. Limitation of damages: The customer(s) shall not recover damages beyond the amount of the inspection fee paid by the customer to ASIS. This limitation shall accrue to the benefit of ARIS, its employees, agents, successors, representatives, inspectors, officers and directors.
5. Arbitration Agreement: The Client and Inspector mutually agree that any and all controversy or claim arising out of or relating to the services provided by ARIS, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association and be in Grand Rapids, Michigan in accordance with its’ applicable expedited procedures. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
6. Right of Inspection: ARIS has the right to inspect any item that the customer(s) have reported in controversy, claim, or dispute. Any refusal to allow the inspection prior to repairs being made voids the customer claim.
7. Estimates: It is understood that any estimates given verbally or in writing during the inspection in the inspection report is for general information only and not to be used in negotiations. Contractors need to be contacted for specific pricing estimates.
8. Lead Based Paint: The customer(s) understands that houses built before 1978 may contain lead based paints and materials inside and out. These materials should be tested by a specialist.
9. Environmental Testing: The customer(s) understands that “No” Environmental Testing will be performed by ARIS as a normal part of this inspection. Any and all Environmental Testing will require an additional fee, some testing fees are substantial.
10. Wood Destroying Insects: The customer(s) understands that a Wood Destroying Insect Inspection and Damage Assessment from a Wood Destroying Insect Infestation is not included as part of this inspection. These items require an additional fee.
11. Home Inspection VS Warranty: The customer(s) understands that a warranty is a policy sold to the buyer that warrants that specific items in the home are in sound condition and will remain in sound condition for a specified period of time. ARIS does not provide a warranty as to the future condition of any portion of this property. Warranties are commercially available for a reasonable cost.

10 Sewer Lines (We recommend that they be cleaned regularly)
11 Pool and Equipment 12 Hot Tubs
13 Mold and Mildew 14 Biologicals, Micro-Biologicals and Chemicals.
15. Bedbugs 16. Pet stains or odors

13. Repairs: The Customer(s) understands that ARIS does not repair or arrange for repairs of any property. The Customer(s) are solely responsible for negotiating repairs, having repairs done and having the repairs inspected.
14. Third Parties: Unless agreed to below ARIS and the Buyer(s) acknowledge, and warrant and represent to each other that the inspection report will not be shared with any other person/organization. Further the Client agrees that there are no third-party beneficiaries to this contract.
15. Integration: This contract constitutes the entire understanding between the parties with respect to the subject matter of this contract and supersedes any prior discussions negotiations, agreements and understandings. The terms of this contract may not be changed unless those changes are in writing and agreed upon by both parties.
16. Severability: Whenever possible, each provision of this contract will be interpreted in such a way as to be effective and valid under applicable law. If a provision is prohibited by or invalid under applicable law, it will be ineffective only to the extent of such prohibition or invalidity, without invalidation the remainder of such provision or the remaining provisions of this contract.
